    Details of functions and duties in the Home Department, Ministry (itself)

    Police Department

    1. Handling of appeals under the Arms Act, Mumbai Police Act, Cinema Act and Rules and Regulations made there under.
    2. Allocate funds in the budget and make distributions / fixed allocations there.
    3. Dealing with matters relating to law and order, security of a very important person, internal and coastal security of the state, installation of very important marches, religious places, etc.
    4. Dealing with matters relating to terrorist / naxalite activities.
    5. Handling of preventive detention cases under the National Security Act, 1980.
    6. Handling of cases under the Foreign Exchange and Prevention of Smuggling Act, 1974.
    7. Handling of cases under Maharashtra Prevention of Cruelty to Animals Act, 1980.
    8. Dealing with cases related to Slum Dadas, Handicrafts, Drug Traffickers and Dangerous Persons Act, 1981 (M.P.D.A. Act of 1981).
    9. Handling of cases relating to Prevention of Black Marketing and Supply of Essential Commodities Act, 1980, etc.
    10. The Bombay Lotteries (Control and Taxation), Prize Competition Act 1958 as well as Prize Competition Rules.

    Act 1955 to deal with pending cases.

    • Handling matters relating to betting and gambling.
    • Licensing and control of cinema (other than promotion of production and distribution of Indian films and exhibition and consumption of educational, scientific and entertainment films).
    • To deal with cases of persons subject to detention relating to preventive detention, maintenance of public order or supply of essential goods and services to the community, carried out for action in relation to the security of the State.
    • All offences against the state, including the act of holding seditious meetings, and dealing with matters such as the Criminal Law Amendment of 1908.
    • Political social movements and subversive activities and preventive measures to be taken to deal with them as well as extraordinary events, inter-social relations, riots, disturbances.
    • Withdrawal / withdrawal of cases under the Criminal Procedure Code.
    • The process of proving a criminal insane, incorrigible, and insane.
    • Explosives Control, Transport, Storage, Manufacture, Testing and Mixture of Petroleum and Other Combustible Substances Carbide and Calcium Rules under the Petroleum Act, 1954
    • Removal of buried dead persons, lost persons, property of the deceased.
    • Arms, ammunitions and ammunition.

    Police Department Home Guards

    1. Appointment of salaried officers of Home Guards Association and District Commanders (Non-Ministerial)
    2. Formation of Home Guards Association with appeals from salaried and voluntary employees
    3. Matters relating to the Bombay Home Guards Act 1947 and the Home Guards Rules 1953.
    4. Reimbursement of expenditure on Home Guards Organization by the Central Government.
    5. Deployment of Home Guards during Emergency

    Civil Defense Force

    1. Appointment of Pay Officer (Non-Monority) of Civil Defense Force Association.
    2. Formation of the Civil Defense Force Association.
    3. Matters relating to the Civil Defense Forces Act, 1968.
    4. Reimbursement of expenditure incurred on Civil Defense Force Organization.
    5. Deployment of civil defense forces in times of emergency.

    Directorate of Public Prosecution

    1. Advising the police and other government department offices on the law of criminal jurisdiction in criminal courts on behalf of the state government and on the appropriate penal provisions of the relevant law.
    2. Filing of appeal and revision application.
    3. To scrutinize cases acquitted by Magistrates, Sessions and High Courts and decide whether or not to appeal.

    Directorate of Forensic Science Laboratories

    1. Establishment matters of Directorate of Forensic Science Laboratory.
    2. Modernization of Forensic Science Laboratories.
    3. Establishment matters at JJ Postmortem Centre Byculla.
    4. Matters relating to police vehicles, machinery, equipment, uniforms, etc.

    Prison

    1. Premature release of life convicts.
    2. Premature release of prisoners on medical grounds.
    3. Article 161 of the Constitution deals with grant of remission to permanent prisoners. to make a recommendation to the Governor.
    4. Pardoning the prisoners.
    5. On a special occasion i.e. Announcement of apology on 15 August, 26 January, 2 October, 14 April.
    6. Temporary suspension of sentence of a convict required for police investigation.
    7. Transfer and release of mentally ill prisoners.
    8. Transfer of prisoners for free residence.
    9. Modifying existing rules, when necessary.
    10. Declare temporary imprisonment, when necessary.
    11. Appointment of Class A/B (Gazetted) posts.
    12. Deciding on the prisoner’s appeal application for leave to plead.
    13. Construction of prisons, modernization of prison industries.
    14. Open prisons, juvenile correctional schools, open prisons for women.

    State Excise Duty

    The provisions of this section / Act are in accordance with the guidelines of Article 47 of the Constitution vide Notification, General Administration Department No. ROB-1089 / Eighteen (O. and A.), dated 28 December 1989 The Fifth Amendment Rules, 1989 came into force. Accordingly, the name of the department “Prohibition and Excise” has been changed to “State Excise.”
    The following Acts are implemented by this department.

    1. The Maharashtra Prohibition Act, 1949
    2. The Bombay Opium Smuggling Act, 1936
    3. The Bombay Drugs (Control) Act, 1959
    4. The Bombay Milli (Control) Act, 1956
    5. The Narcotic Drugs and Psychotropic Substances Act, 1985

    The major functions of the department are licensing and inspection of the Act and enforcement of various controls under the Maharashtra Prohibition Act, 1949 and other Acts on priority, as well as the collection of taxes on beverage alcohol and on drugs containing alcohol and narcotics and narcotic drugs. Apart from this, investigation of drug related offences under the NDPS Act, 1985 as per the Maharashtra Prohibition Act, 1949, registration of cases and filing of related cases in the court, etc.

    Incentive Reward Scheme: –
    Government Decision No. BGT-1016 / PR No. 39 / Raushu-1, dated 9th October, 2017 has been issued to award prizes on the basis of the merit of the case to be registered so that informers and officers get information about the business of illicit brewing, transportation and sale of liquor and qualitative crimes can be detected and crime investigation can be encouraged.

    Scheme for Award of Medals / Medals of Honour for meritorious / meritorious work:
    Considering the meritorious performance of the officers / staff of the State Excise Department during the period of their service, such as outstanding achievement / courage / courage, meritorious performance for raising appropriate investigation revenue, etc., the Government has decided to confer such officers / staff with the following medals and medals on 26th January every year: MIS 1222 / PR No. 01 / Raushu-1 / Shikhana Di. Issued on January 10, 2023.

    Online platform for grievances and online grievance redressal facility:
    A control room has been set up in the office of the Commissioner, State Excise, to obtain information from the public about the illicit liquor trade in the state. A toll-free number 1800 233 9999 and a WhatsApp number 8422 001133 have been made available for the public to lodge complaints. The Maharashtra Prohibition Act, 1949 was amended by inserting a new section 134-A and appointing the Maharashtra Gram Rakshak Dal to ensure public participation in the government machinery to crack down on the manufacture, transport, possession and sale of illicit liquor.

    1. In the case of narcotic drugs and opium, it is listed in List I of the Seventh Schedule to the Constitution of India at Note No. Dealing with matters relating to Alcohol, Drugs (including Dangerous Drugs) and Toxins subject to the provisions of section 59.
    2. State excise duty on further goods produced or manufactured in the state and similar goods produced or manufactured elsewhere in India at the same rate or at a lower rate.
    3. Alcoholic liquor for human consumption.
    4. Medications and toiletries that contain alcohol.
    5. Opium, Indian hemp and other narcotic drugs and psychotropic substances.
    6. Opium cultivation and manufacture or sale for export.
    7. State excise agreements with states in India.
    8. Control and allocation of molasses.

    Transport

    1. Motor vehicles, motor vehicles and public vehicles Motor vehicles (excluding those relating to the issue of motor cars, scooters and other motorised vehicles from the government quota).
    2. Road Transport Services.
    3. Tax demands on vehicles fit for use on the road, whether or not they are mechanised.
    4. Taxes on goods carried by road and on slopes.
    5. Motor Cars (Distribution and Sale) Control Order, 1950 Scooters (Distribution and Sale) Control Order, 1960 and Tractors (Distribution and Sale) Control Order, 1971.
    6. The Maharashtra Motor Vehicles Acquisition and Control Act, 1965.
    7. Maharashtra State Road Transport Corporation.

    Ports

    1. Railways and allied matters (including new railway projects and names of railway stations but excluding bridges over / under railways).
    2. Landing and other means of transport not specified in List I of the Seventh Schedule to the Constitution of India, minor railways subject to the provisions of List I in the case of such railways, inland waterways and transport thereon subject to List I and List III of the Seventh Schedule to the Constitution of India in the case of such waterways.
    3. Matters relating to Major Ports.
    4. Ports other than those declared as Major Ports by or under any law made or existing in Parliament.
    5. The lighthouses with light boats, signal lights and other provisions for the safety of boats and the department.
    6. Duty on sloops and cargo transported through inland waterways.
    7. Navigation and navigation in inland waterways with respect to mechanized navigation and navigation on such waterways and in the case of national waterways, the movement of cargo and cargo by inland waterways subject to the provisions of the List in the Seventh Schedule to the Constitution of India.
    8. The provisions for the education and training of merchant seamen in civil navigation and sailing, including navigation and rowing on tidal waters, and the regulation of such education and training as may be provided for by the Water Steam Navigation Act under the State.
